1. Scope of Application

1.1 These general conditions of sale apply exclusively to sales on Italian territory of the products displayed on the website https://morelato.it/prodotti/.
1.2 To make purchases on the Shop the user must first provide their name, surname or company name and e-mail address to morelato.it.
1.3 The site is in Italian and English and the sales contract can be concluded in both languages chosen by the buyer, with shipping only in Italy. For shipments abroad send a request to export@morelato.it.
1.4 These general conditions of sale can be printed, downloaded and/or stored.
1.5 The placing of the order by the buyer entails acceptance of these general conditions of sale which cannot be modified by the parties except by written document duly signed by them.
1.6. The applicable general conditions of sale will be those in force on the date of sending the purchase order.

2. Information aimed at the conclusion of the contract

In compliance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, Morelato S.r.l. informs the user that:
• to conclude the purchase contract for one or more products on the Shop, the user must complete an order form in electronic format and send it to Morelato S.r.l., electronically, following the instructions that appear from time to time on the Shop and which will accompany the different stages of the purchase;
• the contract is concluded when Morelato S.r.l. register the order form;
• before proceeding with the purchase of the products and sending the order form, the user will be asked to read and approve the General Conditions of Sale; the user can print a copy of the General Conditions of Sale; before proceeding with the transmission of the order form, the user will be able to identify and correct any data entry errors by following the instructions indicated from time to time on the Shop and which will accompany the different phases of the purchase;
• once the order form has been registered, Morelato S.r.l. will send the user an order confirmation via e-mail containing information relating to the characteristics of the product purchased, a detailed indication of the price, the means of payment used, shipping costs and any additional costs and an indication of the customer care. It is recommended to keep the email received as proof of purchase;
• the order form will be archived in the Morelato S.r.l. database. for the time necessary to process the order and, in any case, within the terms of the law. To access your order form, the user can consult the “Orders” section of the Shop where he will find the list of all orders placed.

3. Orders

Purchase orders will be processed only after receipt by Morelato S.r.l. confirmation of payment of the total amount due, consisting of the purchase price of the product(s) and any shipping costs.
Before executing the contract, Morelato S.r.l. will have the right to verify the orders transmitted by users in order to ascertain any behavior evading the purchase ban, fraud in the use of credit cards or anomalous purchases. In particular, pursuant to art. 1456 c.c., Morelato S.r.l. will have the right to terminate the contract and, consequently, to cancel the order and to refund the total amount due to the user, if:
• the order appears to come from a person who has no right to make purchases on the Shop;
• the order appears to come from a person who has no right to make purchases on • the credit card used for payment is cloned or there is reasonable doubt that the purchase was not made by the owner of the same or in the case which the credit card issuing company informs Morelato S.r.l. that the card has been blocked;
• the order transmitted by the user presents an anomaly in relation to the type and/or quantity of the products purchased or the frequency of purchases made on the Shop;
• on the date of purchase the user is in default of the obligations deriving from or in any case connected to the execution of a previous contract concluded with the Company.

In the Shop, next to the description of each product, Morelato S.r.l. will indicate whether or not it is immediately available. However, since, due to the specific methods of online purchasing, it is possible for multiple users to purchase the same product at the same time, it is possible that at the time of registration of the purchase order by Morelato S.r.l. the product ordered is no longer available. In this case, Morelato S.r.l. will promptly inform the user who, at his choice, can request the cancellation of the purchase order and obtain a refund of any sum paid.
In the event that the order is cancelled, Morelato S.r.l. will refund the user the amount paid and credit the refunded amount to the same payment method used for the purchase immediately and, in any case, within thirty days starting from the day after sending the order. Any delays in crediting may depend on the banking institution or the type of credit card used for payment. In any case, the value date of the credited amount will be the same as the debit.

4. Payment methods

Payment for products purchased on the Shop can be made in the following ways:
– Credit Card (Visa, Mastercard and Visa Electron)
– PayPal
– Bank transfer

In the case of payment by credit card, the user will enter the relevant data on the Shop and Morelato S.r.l. will transmit them for the execution of the payment order, in encrypted format and according to the established security requirements.

After the purchase, Morelato S.r.l. will not retain credit card information.

If the user selects PayPal as the chosen payment method, Morelato S.r.l. will allow you to connect directly to http://www.paypal.it/it and follow the procedure provided by PayPal. The data entered on PayPal will be processed directly by it and will not be transmitted or shared with Morelato S.r.l.. In the event of cancellation of the order and in all cases of reimbursement, for any reason, the amount paid to Morelato S.r.l. will be credited to the user’s PayPal account. Once the credit order has been placed, Morelato S.r.l. will not be responsible for any delays or omissions in crediting the refunded amount connected to the management of the PayPal Shop.
After processing each order, Morelato S.r.l. will send the user, by e-mail, the invoice or tax receipt relating to the purchase made by the user.

5- Products: prices and characteristics

5.1 The images of the Products on the Site are reproductions of the physical products and despite the adoption of technical solutions to minimize inaccuracies, there may be some discrepancies (for example color resolution) between the images and the Products.
5.2 Furthermore, differences may exist between the Products delivered and those present on the Site or in the catalogue, in particular for artisanal Products for which the homogeneity of production cannot be totally guaranteed or for Products which have been subject to adaptations linked to technical or technological evolution. Such differences, in the event that they do not concern the essential characteristics of the Products and do not affect their quality, cannot justify the cancellation of the order or a refusal of delivery, without prejudice to the exercise of the right of withdrawal referred to in the following article 8 .
5.3 Morelato S.r.l. reserves the right to modify the assortment of Products displayed on the Site at any time.
5.4 The prices of the Products are indicated in Euros and include VAT or other sales taxes that may be applicable. Morelato S.r.l. reserves the right to change the prices of the Products displayed on the Site at any time before starting the ordering procedure.
5.5 The prices of the Products indicated on the Site include shipping costs in Italy using the “street level” method. We do not carry out floor deliveries or product assembly.
5.6 For shipments abroad, make a request by sending an email to export@morelato.it.
5.7 The total price of the order, including standard shipping costs, will be highlighted before the buyer selects the “Pay now” button.

6. Delivery of products

6.1 The Products are delivered to the address indicated by the Customer at the time of the order and from the actual moment of physical delivery of the products the risks relating to them are transferred to the buyer. Shipments will take place after receiving confirmation of payments: for the Bank transfer is confirmed by the credit in our current account, for payment via Pay Pal the confirmation of the transaction by the circuit is valid.
6.2 For our shipments we rely on the service of qualified express couriers or couriers specialized in the delivery of furniture and furnishings to guarantee the quality of the service and the integrity of the Products.
Shipments are made only in Italy. For countries outside Italy, request a quote at export@morelato.it
We do not ship to post office boxes.
6.3 If the buyer’s shipping address is geographically remote or not very accessible, for example, the Venice Lagoon, islands or isolated locations, it is possible that Morelato S.r.l. is not able to deliver there or that for these destinations there is an additional cost which may be charged to the buyer. In such cases, methods and any additional costs will be agreed from time to time.
6.4 The order relating to a plurality of Products cannot be shipped in fractions and will necessarily be shipped in full, to the delivery address specified by the buyer.
6.5 Standard shipping will be carried out via a courier such as SDA or a specialized transporter using the “street level” method. The delivery dates indicated on the Site are purely indicative. Once confirmation of order acceptance has been sent, the buyer will be notified via e-mail that the Product has been shipped.
Morelato S.r.l. has the right, at its sole discretion, to deliver the Products ordered via a courier of your choice.
6.6 The standard shipping cost indicated on the Site assumes that there are no obstacles to the unloading of the goods. The buyer is required to ensure that the indicated delivery address is accessible to allow the unloading of the goods. In the event that for unloading it is necessary to occupy public land, access restricted traffic zones, and/or use external equipment and/or there is any other obstacle to the unloading of the Products, the purchaser must communicate this at the time of unloading. placing the order, reporting it on the Checkout page, in the space called “Order Notes”. The occupation of public land, as well as the need for any external equipment to carry out the unloading, are not included in the standard shipment and involve an additional unloading service which must be requested from the specialized transporter and which may involve an additional cost which cannot be quantified at the moment, as it depends on the state of the premises at the address of delivery, the size of the Products, and any additional costs applied by the carrier. These costs will be communicated by Morelato S.r.l. to the buyer by e-mail after receiving the order and, unless otherwise agreed, must be paid to Morelato S.r.l. before the departure of the goods. The buyer will have the right to cancel the order if, after having been informed of the additional cost for this additional service, he does not agree to bear it.
6.7 If the non-accessibility to the unloading places, or the existence of obstacles to the unloading of the Products, including access to the restricted traffic zone, is discovered only at the time of delivery or in the event that the buyer is not present at the time of delivery agreed upon and the designated transporter is unable to contact the buyer, after having made reasonable attempts to organize delivery and/or redelivery, the Products will automatically be returned to Morelato S.r.l. which may terminate the sales contract by charging the buyer a penalty of Euro 100.00 in addition to the delivery costs, amounts which will be withheld from the price paid upon return of the same.
6.8 Upon receipt, the Customer must verify the content, conformity and condition of the Product(s). Therefore, upon delivery, Morelato S.r.l. recommends that the Customer proceed to check the status of the Products delivered before signing the acknowledgment of receipt, and to ensure in particular:
– that the number of packages delivered corresponds to what is indicated in the transport document attached to the shipment;
– that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents.
If the Customer notices anomalies, he is required to refuse delivery of the products or write down his reservations in a detailed and dated document. If the courier’s document is signed without making any “reservations”, the Customer will not be able to make any objection regarding the external characteristics of what was delivered.
6.9 Most of our products arrive pre-assembled. While for the items delivered which bear the wording “to be assembled” in the shop, assembly is in most cases quite simple and consists of assembling already defined pieces, following the assembly instructions always attached to the furniture, inserted inside of the packaging

7. Product compliance

7.1 Upon receipt of the products, the buyer must verify the correspondence of the Products, their integrity and conformity with the sales contract.
In the event of Products delivered not intact and/or if there are anomalies, the buyer is obliged to report it within 5 days of delivery by sending an email to morelato@morelato.it, with a description of the non-conformity.
7.2 Morelato S.r.l. is not responsible for defects resulting from improper use of the Products.

8. Right of withdrawal

8.1 The consumer purchaser, pursuant to art. 52 of the Consumer Code (Legislative Decree 206/2005) and without prejudice to the exclusions referred to in art. 59 of the same Code, has the right to withdraw without any penalty, without specifying the reason and without having to incur costs other than those provided for in these Conditions, within 14 (fourteen) days from the day on which the Buyer or a third party, other than the carrier and designated by the Buyer, acquires physical possession of the package containing the ordered goods.
8.2 The right of withdrawal is subject to the following conditions:
• the right applies to individual items purchased in their entirety;
• the purchased item must be intact and returned in the original packaging, complete in all its parts (including packaging and accessory documentation);
• shipping costs relating to the return of the product are borne by the Buyer; the shipment is under his complete responsibility.
8.3 If the right of withdrawal has been correctly exercised, Morelato S.r.l. will refund the entire amount already paid, within 30 (thirty) days of receiving the notice of withdrawal, after verifying the integrity of the returned Product.
8.4 To exercise the right of withdrawal, the consumer Buyer is required to inform Morelato S.r.l. by sending an email to the following address: morelato@morelato.it, deciding to withdraw from the contract through an explicit declaration.
8.5 To comply with the withdrawal deadline set out in these conditions of sale, it is sufficient for the consumer Buyer to send the communication relating to the exercise of the right of withdrawal before the expiry of the period itself – art. 54, co. 2 Legislative Decree. 206/2005.
8.6 In the event of withdrawal, the consumer Buyer must return the ordered Products by sending them via courier of his/her choice to the Morelato S.r.l. headquarters. (Via Valmorsel 540, 37056 Salizzole – VR) without undue delay and in any case within 14 (fourteen) days from the date on which he communicated to the Seller his decision to withdraw from the contract – art. 57, co. 1 Legislative Decree. 206/2005.
8.7 The aforementioned deadline is considered respected if the consumer Buyer sends back the goods before the expiry of the period of 14 (fourteen) days from the date on which he communicated to the Seller his decision to withdraw from the contract.
8.8 If the Consumer Buyer withdraws from this contract, he will be refunded all payments he has made to the Seller, including delivery costs, without undue delay and in any case no later than 30 (thirty) days from the day on which the Seller has been informed of the decision to withdraw from this contract, after verifying the integrity of the returned Product. These refunds will be made using the same payment method used by the Buyer for the initial transaction. In any case, the Buyer will not have to bear any costs as a consequence of such reimbursement.
8.9 The direct cost of returning the goods, i.e. shipping costs and any other related expenses as provided for pursuant to art., remains the responsibility of the Consumer Buyer. 57 Legislative Decree. 206/2005.
8.10 The Products must be returned to the Seller in their substantial integrity, with their original packaging, accessories, instructions for use and anything else supplied with them.
8.11 The Consumer Buyer is responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods – art.57, co.2 Legislative Decree. 206/2005.
8.12 The Seller only accepts correctly addressed parcels or registered letters and does not accept – under any circumstances – parcels with shipping paid by the recipient. Any risk associated with the return of the Products will be borne exclusively by the Buyer.

9. Safeguard clause

9.1 In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and effectiveness of the other provisions present in the extended General Conditions of Sale.

10. Intellectual and industrial property

10.1 Morelato S.r.l. is the owner of the intellectual property rights of the Site and the right to disseminate the elements contained in the online store catalog and, in particular, the photographs for which it has obtained the necessary authorizations from the interested parties. Consequently, the partial or total reproduction, on any type of support, of the elements that make up the site and the catalogue, their use as well as their transfer to third parties are formally prohibited.

11. Competent Court

11.1 In the event of a dispute and in the absence of an amicable agreement reached between the parties, without prejudice to the possible applicability of mandatory provisions of law aimed at protecting consumers (as defined pursuant to art. 1 letter b) of the Legislative Decree 22 May 1999 n. 185), any dispute connected to these General Conditions will be referred to the exclusive jurisdiction of the Court of Verona.
